The obligation

What the contract requires.

“within sixteen (16) months of the Effective Date, Developer shall have successfully received approval of a Final Building Inspection and a Final Fire Inspection”Executed agreement, p. 4
“reduction of unemployment and underemployment through the production of 15 full-time jobs”Executed agreement, p. 1
“the Project, at a total estimated value of approximately $800,000, will bring to the City through development”Executed agreement, p. 1
The remedy

The agreement terminates.

“If this Agreement is terminated by the City for Developer’s failure to timely submit an application for a Certificate of Occupancy for the Project, this Agreement shall terminate and the City reserves the right to require the Developer to pay the remaining balance of the calculated impact fees, in the amount of $195,977.05”Executed agreement, p. 2

This clause ends the agreement. It states no repayment of money already received.

Where a deadline above has passed, no public record exists of whether it was met — not in the Comptroller’s filings, nor in the local government’s own disclosures. That is not evidence of non-compliance. Texas requires nobody to record it.
