The obligation

What the contract requires.

The remedy

The agreement terminates.

“If such non-compliance is not cured within sixty (60 ) days after Company’s receipt of such notice or, if non-compliance is not reasonably susceptible to cure within sixty (60 ) days and a cure is not begun within such 30-day period and thereafter continuously and diligently pursued to completion on a schedule approved by the County (in either event, a “Cure’), then the County may, at its sole discretion, terminate t”Executed agreement, p. 12

This clause ends the agreement. It states no repayment of money already received.

Where a deadline above has passed, no public record exists of whether it was met — not in the Comptroller’s filings, nor in the local government’s own disclosures. That is not evidence of non-compliance. Texas requires nobody to record it.
