December 31, 2017performance deadline
The obligation

What the contract requires.

“On or before December 31, 2017, HHS shall cause the Real Property Improvements to be constructed.”Executed agreement, p. 4
“On or before September 1, 2018 HHS shall employ at least seventy-seven (77) persons in Jobs”Executed agreement, p. 3
“Real Property Improvements (as defined below) and the creation of new Jobs. Section 2.07. “Real Property Improvements” means an approximately 45,000 square foot building and related facilities on the Land and having an estimated value of at least $2,150,000.00”Executed agreement, p. 3
The remedy

Future payments stop.

“If, at the end of any applicable year during the Term, HHS is not in compliance with the obligations to create and maintain Jobs, as provided in this Agreement, including compliance with the residency requirements under Section 3.01(a), the County may withhold Compliance Payments that would otherwise be due to HHS for that year.”Executed agreement, p. 9

This clause stops money not yet paid. It does not require what has already been received to be returned.

Where a deadline above has passed, no public record exists of whether it was met — not in the Comptroller’s filings, nor in the local government’s own disclosures. That is not evidence of non-compliance. Texas requires nobody to record it.

What was abated, and for how long.

seventy-five percent (75%)2018
seventy-five percent (75%)2019-2027

A local abatement waives only that taxing unit’s share of the property tax bill. School districts, counties, cities and hospital districts each sign separately.
