The obligation

Terms the contract defines.

“Termination Date” means December 31, 2030”Executed agreement, p. 4
“an employment level of eight hundred seventeen (817) full-time employees”Executed agreement, p. 4

The dated sentence above defines a term used elsewhere in the contract. It is recorded here as a definition, not as a performance obligation.

The repayment remedy

What happens if it is not met.

“Recapture: In the event GP] (i) allows its Ad Valorem Taxes owed to the COUNTY, that are subject to this agreement, to become delinquent or fails to timely and properly follow the legal procedures for the protest and appeal of the Ad Valorem Taxes or (ii) defaults under this AGREEMENT and fails to cure, this AGREEMENT may then be terminated. In the event of termination of this AGREEMENT pursuant to the provisions of ”Executed agreement, p. 7

The remedy here is discretionary — the clause says it may be applied, not that it must be.

Where a deadline above has passed, no public record exists of whether it was met — not in the Comptroller’s filings, nor in the local government’s own disclosures. That is not evidence of non-compliance. Texas requires nobody to record it.
